Terms and Conditions

Please read these Terms and Conditions carefully before using the services offered by Pixie Creative, operated by Maryam. By accessing our website at www.pixiecreative.ca or engaging our services, you agree to be bound by these terms.
About Us
Pixie Creative is a Toronto-based design studio offering branding and ongoing design services to clients across the Greater Toronto Area (including Mississauga, Brampton, North York, Vaughan, and Oakville), throughout Canada, and internationally. All services are delivered remotely.
Services
We offer: Dedicated Monthly Designer - an ongoing retainer for consistent brand support. Brand Identity Design - logos, colour palettes, typography, and brand guidelines. Website Design - strategic design to communicate your brand clearly. Marketing and Visual Design - brochures, social media graphics, landing pages, and campaign assets. All scopes, deliverables, timelines, and fees are agreed upon in writing before work begins.
Payments
A deposit is required before work commences. Final deliverables are released upon full payment. All prices are in Canadian dollars (CAD). Invoices not paid within 14 days may incur a late fee of 2% per month.
Monthly Retainer Terms
Retainers are billed at the start of each billing cycle. Unused design credits roll over for 30 days, after which they expire. Any rolled-over credits from the previous month are applied only after the current months credits have been fully utilized. To cancel, written notice is required at least 14 days before your next billing date.
Revisions and Scope
Each project includes a defined number of revision rounds as outlined in your agreement. Out-of-scope requests may incur additional charges, communicated to you in advance.
Intellectual Property and Ownership
Upon full payment, you own the final approved deliverables. Pixie Creative retains the right to display work in our portfolio unless you request otherwise in writing. We retain ownership of all drafts, concepts, and unused designs.
Confidentiality
All client information is treated as strictly confidential and will not be shared with third parties without your written consent, except where required by law.
Client Responsibilities
You agree to provide timely feedback, materials, and approvals. Delays caused by the client may affect timelines and are not Pixie Creatives responsibility. Projects on hold for more than 30 days may require a restart fee.
Cancellations and Refunds
Work completed up to cancellation will be billed. Deposits are non-refundable unless Pixie Creative cannot commence work. All retainer payments are non-refundable, including partially or fully delivered periods.
Limitation of Liability
Pixie Creative is not liable for any indirect or consequential damages. Our total liability is limited to the amount paid for the specific project or billing cycle in question.
Disclaimer of Warranties
Services are provided as-is. We make no guarantees regarding specific business outcomes such as increased sales, website traffic, or audience growth.
Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Ontario.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our services constitutes acceptance of the revised Terms.
